Two years of paid experience, and a 25-hour course
Utah Code 58-55-302(1)(e)(ii)(A) requires a contractor applicant to produce evidence of "two years full-time paid employment experience in the construction industry," which "may be related to any contracting classification and does not have to include supervisory experience," with no employment experience required for a specialty contractor licence. Subsection (1)(e)(iii) adds a 25-hour prelicensure course, and (1)(e)(iv) adds a five-hour business and law course for the general and residential classifications. Financial responsibility is a questionnaire or a bond, and it never stops
Utah Code 58-55-306(1) requires an applicant, and a licensee applying for renewal or reinstatement, to demonstrate financial responsibility either by completing and certifying a division questionnaire or "by submitting a bond in an amount and form determined by the commission with the concurrence of the director." Subsection (2) requires a licensee to "maintain financial responsibility throughout the period of licensure," and subsection (3) lets the division audit it "on a random basis or upon finding of a reasonable need." Trading under a name other than the licensed one is unlawful
Utah Code 58-55-501(10) makes it unlawful to allow "one's license to be used by another except as provided by statute or rule," and 58-55-501(11) makes it unlawful to do "business under a name other than the name appearing on the license, except as permitted by statute or rule." The Utah Legislature's own chapter PDF publishes two texts for much of Title 58 Chapter 55, banner-marked "Superseded 1/1/2027" and "Effective 1/1/2027". Several old numbers are being RE-USED for different subjects: 58-55-604 moves from the prerequisite-to-suit bar to "Citations -- Fines -- License suspension -- License revocation", 58-55-501 moves from "Unlawful conduct" to "Definitions", 58-55-602 moves from payment of construction funds to "Penalty for unlawful conduct". The records you need, and the order that works

A Utah contracting company normally ends up with three records: an entity registered with the Division of Corporations and Commercial Code at the Department of Commerce, a construction trades licence from the Division of Professional Licensing under Title 58 Chapter 55, and a business licence from each municipality it operates in under Utah Code 10-1-203(2). None of the three is a substitute for another.

Form the entity first, because the trades licence is issued in a name and Utah polices that name hard. Utah Code 58-55-501(11) makes it unlawful to do "business under a name other than the name appearing on the license, except as permitted by statute or rule," and 58-55-501(10) makes it unlawful to allow "one's license to be used by another except as provided by statute or rule." Getting the entity name settled before the licence application avoids an amendment on both sides.

One source note before you go looking for fees. corporations.utah.gov now redirects to commerce.utah.gov/corporations/, and the live Business Entities page there lists entity categories and a search tool but publishes no filing fee, no annual renewal rule and no registered agent requirement in its own text - it links a separate fee schedule instead. We state no Utah entity figure anywhere in this guide for that reason. Ask the Division for the current schedule.

The municipal licence comes last in sequence but should not come last in planning, because Utah Code 10-1-203(2) makes it a per-municipality requirement and a contractor working across a valley may need several. We publish no municipal figures: Contractor Lane holds no Utah local jurisdiction record that has cleared source review for publication.

What the trades licence application asks for

Utah Code 58-55-302(1) sets out the checklist. An applicant must "submit an application the division approves," "pay a fee as determined by the department under Section 63J-1-504," and meet the examination requirements, which for the general and residential classifications means "a division-administered examination that covers information from the 25-hour course" plus, where that course was completed on or after 1 July 2019, the five-hour business law course. For an apprentice electrician, apprentice plumber or specialty contractor, subsection (1)(c)(i) requires no division-administered examination at all.

For a contractor licence specifically, subsection (1)(e) adds four things: satisfactory evidence of financial responsibility; "two years full-time paid employment experience in the construction industry," which "may be related to any contracting classification and does not have to include supervisory experience" and is not required for a specialty licence; evidence of "knowledge of the principles of the conduct of business as a contractor, reasonably necessary for the protection of the public health, safety, and welfare"; and completion of the 25-hour prelicensure course, which may cover "construction business practices, bookkeeping fundamentals, mechanics lien fundamentals" and other business and construction principles and may include a provider-administered examination at the end for no additional fee.

Where the applicant is a business entity, Utah Code 58-55-302(1)(c)(iii) requires, if Section 58-55-304 so provides, "that an individual qualifier pass the required division-administered examination." The qualifier concept is the link between the company that holds the licence and the person whose competence supports it, and 58-55-304 - which becomes 58-55-107 on 1 January 2027 - is where the licensee-name, licence-number and qualifier rules live.

Financial responsibility runs through Utah Code 58-55-306. Subsection (1) allows either a completed and certified division questionnaire or "a bond in an amount and form determined by the commission with the concurrence of the director." Subsection (5) gives the division extra powers where the applicant is an unincorporated entity: it "shall consider the personal financial information of each individual who holds an ownership interest," may audit that information or obtain a credit report, and where it finds a lack of financial responsibility may prohibit the individual from engaging in a construction trade, require the individual to dissociate within 10 days, or require a bond.

The notifications that keep the licence alive

This is the part new Utah contractors most often miss, and it has teeth. Utah Code 58-55-503(4)(b) makes grounds for immediate suspension of a licence "the failure by a licensee to make application to, report to, or notify the division with respect to any matter for which application, notification, or reporting is required under this chapter," and gives three examples by name.

The first is "applying to the division for a new license to engage in a new specialty classification or to do business under a new form of organization or business structure." Converting a sole proprietorship to an LLC, or a partnership to a corporation, is not merely a Division of Corporations transaction. The second is "filing a current financial statement with the division." The third is "notifying the division concerning loss of insurance coverage or change in qualifier."

Put that beside Utah Code 58-55-306(2), which requires a licensee to "maintain financial responsibility throughout the period of licensure," and 58-55-306(3), which lets the division audit it "on a random basis or upon finding of a reasonable need." Financial responsibility is a continuing state, not a one-off application item, and the division does not have to wait for a complaint to look at it.

Why any of this matters beyond the licence itself: Utah Code 58-55-604, and from 1 January 2027 58-55-210, bars a contractor from bringing or maintaining a court action to collect compensation for work requiring a licence unless it held the required licence at the contract date and when the cause of action arose. An immediate suspension triggered by a missed notification is exactly the kind of gap that turns a straightforward invoice dispute into a licensing argument.

Term, renewal and the renumbering

The term-of-licence, expiration and renewal rules sit at Utah Code 58-55-303 today and move to 58-55-108 on 1 January 2027. Because the chapter is being recodified in stages - 58-55-102 Definitions carries a separate "Superseded 10/1/2026" and "Effective 10/1/2026" pair - it is worth checking the banner on any section you rely on rather than assuming a single changeover date.

The renumbering matters most for anything you write down. A contract clause, an internal procedure or a website page citing "Utah Code 58-55-604" today points at the prerequisite-to-suit bar; from 1 January 2027 the same citation resolves to "Citations -- Fines -- License suspension -- License revocation." A citation to 58-55-501 points at unlawful conduct today and at a definitions section from 2027. Those failures are silent, because the number still resolves to a real section.

The safe practice while registering a new company is to write both numbers into anything durable: "Utah Code 58-55-604 (from 1 January 2027, 58-55-210)" and "Utah Code 58-55-305 (from 1 January 2027, 58-55-110)". This guide does that throughout, and it costs nothing except a few extra characters.

Utah publishes its statutes well and its rules badly, and this guide reflects that. Where a claim here is statutory, it comes from the Utah Legislature's chapter PDF, which prints the full chapter as real text and banner-marks every superseded and future-effective version inline. Do not use the per-section HTML pages at le.utah.gov: they return HTTP 200 with about 26 KB of navigation chrome and no statutory text at all, which means a link checker will report them healthy while they tell a reader nothing.

Three gaps to know about before you budget. First, no Utah Administrative Code figure appears anywhere in this guide, for the reasons above: the current code at adminrules.utah.gov served us nothing, and the only readable copy of R156-55a is dated July 2019. Second, no Utah entity filing fee appears, because the Division of Corporations page publishes none in its own text and links a separate fee schedule; note also that corporations.utah.gov now redirects to commerce.utah.gov/corporations/. Third, no licence application, examination or renewal fee appears: Utah Code 58-55-302(1)(b) sets the fee only as "a fee as determined by the department under Section 63J-1-504."

And the date. If you are reading this on or after 1 January 2027, check every section number in it against the current chapter, because Utah moved most of them and re-used several. This guide gives both numbers wherever the change matters.

We do not state a figure, because Utah does not publish one on any page we could read. Utah Code 58-55-302(1)(b) requires an applicant to "pay a fee as determined by the department under Section 63J-1-504" - the statute delegates the amount rather than setting it. The Division of Professional Licensing site returned HTTP 403 to us on every path tried, so no DOPL fee schedule is cited. On the bond side, Utah Code 58-55-306(1)(b) allows financial responsibility to be shown by "submitting a bond in an amount and form determined by the commission with the concurrence of the director," and the amounts live in Utah Administrative Code R156-55a, whose only readable copy is a July 2019 archive that we will not quote figures from. Do I have to tell Utah's licensing division if I change from a sole proprietorship to an LLC?

Yes, and failing to do so is grounds for immediate suspension. Utah Code 58-55-503(4)(b)(i) names "applying to the division for a new license to engage in a new specialty classification or to do business under a new form of organization or business structure" as one of the matters a licensee must apply for, report or notify the division about, and subsection (4)(b) makes failure to do so grounds for immediate suspension of the licence. It sits alongside two other named examples: "filing a current financial statement with the division" and "notifying the division concerning loss of insurance coverage or change in qualifier."

Can I trade under a different name from the one on my Utah licence?

Not without statutory or rule authority. Utah Code 58-55-501(11) makes it unlawful to do "business under a name other than the name appearing on the license, except as permitted by statute or rule," and 58-55-501(10) makes it unlawful to allow "one's license to be used by another except as provided by statute or rule." Utah Code 58-55-503(2)(a) makes a violation of 58-55-501(10) a class A misdemeanor. The licensee-name and licence-number rules live at 58-55-304 today and move to 58-55-107 on 1 January 2027; check the current text there before adopting a trading name that differs from the licensed one.

Why does this guide give two Utah section numbers for the same rule?

Because Utah is renumbering Title 58 Chapter 55 effective 1 January 2027, and re-using several old numbers for different subjects. The Legislature's chapter PDF publishes both texts, banner-marked "Superseded 1/1/2027" and "Effective 1/1/2027". The prerequisite-to-suit bar moves from 58-55-604 to 58-55-210, while 58-55-604 becomes "Citations -- Fines -- License suspension -- License revocation." The unlawful conduct list at 58-55-501 is replaced by a definitions section at the same number. A citation to a re-used number does not fail visibly; it resolves to a real section that says something else. Giving both numbers is the only way to write a Utah citation today that survives the changeover.
