Quick facts
- Start with the legal owner
- A sole proprietor operates as the individual owner. An LLC or corporation is created through the Alabama Secretary of State before tax, insurance, bond, and license records are filed under that entity.Alabama Secretary of State Business Entities; Alabama Department of Revenue B.E.S.T. Checklist
- There is no single contractor test
- Alabama separates General Contractors, Home Builders, and dedicated trades such as plumbing, electrical, HVAC, onsite wastewater, alarms, wells, manufactured housing, home inspection, and elevators.Alabama General Contractor Threshold Notice; Alabama General Contractor Classifications; Alabama Home Builders Board Unlicensed Builders Guidance; Alabama Home Builders Applicant FAQs; Alabama Construction Management Trade Board Directory
- Project thresholds matter
- The current general-contractor and subcontractor threshold is $100,000. - Local licensing still exists
- The Department of Revenue checklist directs a new business to the county probate office for applicable state or county business privilege licenses and to the city clerk for city business licenses.Alabama Department of Revenue B.E.S.T. Checklist
Compare ownership and administration, not slogans
A sole proprietor is the individual owner. It is operationally direct, but the contracts and business obligations sit with that person. An LLC is a separate state-created entity with its own formation and maintenance records. The owner should discuss tax classification, liability, payroll, banking, ownership changes, and estate planning with qualified advisers instead of assuming that an LLC automatically solves every risk.
For licensing purposes, identify who will be the applicant and who will qualify or supervise the work under the responsible board. Some records attach to an individual, some to a company, and some require both. Changing from sole proprietor to LLC later can mean a new board, tax, insurance, bond, banking, contract, and local-license process rather than a simple name edit.
- Identify who will sign customer and subcontractor contracts.
- Decide who owns vehicles, tools, receivables, and liabilities.
- Confirm how the board treats the company and qualifying individual.
- Price the administrative cost of keeping entity records current.

Use the Alabama startup sequence
First define the owner, exact legal name, any trade name, services, property types, largest expected contract, and whether workers or subcontractors will perform regulated trades. Second, create the LLC or corporation if one will own the company. Third, obtain federal and Alabama tax accounts that match the operation. Fourth, complete the correct company and individual contractor or trade credentials. Fifth, obtain the applicable county and city business licenses, address-level permits, insurance, and bonds before advertising or contracting where the law reaches the offer.
Do not order this sequence by what is easiest to buy online. The owner name on the entity record should match the tax registration, board application, financial statement, insurance certificate, bond, bank account, contracts, vehicles, and permit records. A mismatch can create a delay even when every separate document is genuine. Save accepted confirmations rather than screenshots of unfinished application screens.

Choose the license route from the actual work
For a covered commercial or public construction undertaking at $100,000 or more, start with the Alabama Licensing Board for General Contractors and its current major and specialty classifications. For qualifying residential construction, remodeling, repair, or improvement above $10,000, start with the Home Builders Licensure Board. Residential roofing has the separate over-$2,500 trigger, and swimming-pool construction has the Board FAQ's $5,000 trigger.
Then check whether a dedicated regulator controls the trade even below those broad project thresholds. Alabama has separate routes for plumbing and gas fitting, electrical work, HVAC and commercial refrigeration, onsite wastewater, electronic security, horticulture and structural pest services, water-well drilling, manufactured-home installation, home inspection, elevator work, and Fire Marshal permits. A broad company classification never substitutes automatically for the required individual, qualifier, company, permit, or inspection record.

Make the choice before downstream filings
Write a short ownership memo listing the owner, desired tax treatment to discuss with an accountant, capitalization, bank signer, major assets, planned employees, qualifying person, succession plan, and whether outside owners may join. Use that memo to compare a sole proprietorship and LLC based on the actual company rather than on a generic startup recommendation.
After choosing, file every downstream record under that owner. Do not let the individual hold the insurance while the LLC signs contracts, or let a trade name appear as the bond principal when the board licensed a different owner. Ask the board and broker to confirm any owner-specific wording before payment.

Build one permanent compliance file
Keep the accepted entity record, federal and Alabama tax-account confirmations, county and city business privilege licenses, every company and individual trade credential, exam or experience approval, financial statement, insurance certificate, bond, renewal notice, vehicle or advertising requirement, and permit contact in one controlled folder. Record the responsible person and renewal date beside each item. Do not rely on email search as the only system.
For each job, create a smaller file with the written scope, property type, total undertaking, license numbers, permit, plans, inspections, tests, subcontractor credentials, insurance evidence, change orders, customer approvals, invoices, payment history, closeout documents, and warranty information. That record supports renewals, tax filings, complaints, collections, and the next estimator who needs to know exactly what the company can sell.

Recheck official sources before spending or signing
Agency forms, fees, board schedules, classifications, renewal cycles, and local permit procedures change. Open the cited source again immediately before filing. Confirm the current application package, payment method, supporting documents, legal name, responsible individual, experience or exam approval, bond form, insurance wording, and local jurisdiction. A source that was correct when this guide was reviewed can still change before the next filing.
If the planned service crosses more than one board, send the exact written scope to each regulator and keep the response. Do the same with the city or county permit office for the first job address. A short, documented pre-bid check is cheaper than changing the entity, policy, bond, advertisement, contract, or crew after a regulator or inspector identifies the wrong route.

Common questions
Does an Alabama LLC replace a contractor or trade license?
No. The LLC is the legal owner. General-contractor, home-builder, dedicated trade-board, individual worker, company registration, business privilege license, permit, inspection, insurance, and bond requirements are separate records.

Does staying below one threshold make every Alabama trade unlicensed?
No. The broad General Contractors and Home Builders thresholds do not cancel dedicated plumbing, electrical, HVAC, alarm, onsite-wastewater, well, manufactured-housing, inspector, elevator, fire, or other program requirements. Check the exact work and regulator.
